“Toddlers are being detained.”
AP: “Trump administration officials have been sending babies and other young children forcibly separated from their parents at the U.S.-Mexico border to at least three “tender age” shelters in South Texas. … Doctors and lawyers who have visited the shelters said the facilities were fine, clean and safe, but the kids — who have no idea where their parents are — were hysterical, crying and acting out.”
“The thought that they are going to be putting such little kids in an institutional setting? I mean it is hard for me to even wrap my mind around it. Toddlers are being detained.” — Kay Bellor, vice president for programs at Lutheran Immigration and Refugee Service, which provides foster care and other child welfare services to migrant children.
On Monday DHS Secretary Kirstjen Nielsen dodged questions about the whereabouts of these children.
NYT Transcript:
REPORTER: A couple of questions. One, why is the government only releasing images of the boys being held? Where are the girls? Where are the young toddlers?
NIELSEN: I don’t know. I’m not familiar with those particular images so I would have —
REPORTER: Do you know where they are? Do you know where the girls are? Do you know where the young toddlers are?
NIELSEN: We have children in D.H.S. care both, but as you know, most of the children after 72 hours are transferred to H.H.S. So I don’t know what pictures you’re referencing but I would have to refer you to H.H.S.
REPORTER: We’ve seen images of boys but we just haven’t seen any of the girls, any of the young toddlers and you’re saying they are being well cared for. So how could you make that claim if you don’t know where they are?
NIELSEN: It is not that I don’t know where they are. I’m saying that the vast majority of children are held by Health and Human Services. We transfer them after 72 hours. I don’t know what pictures you’re speaking about. But perhaps they’re —
REPORTER: Pictures have been released to the public, they’ve been aired all over national television.
NIELSEN: O.K., by D.H.S. or H.H.S.?
REPORTER: By [inaudible] .H.S.
NIELSEN: So let’s find out from H.H.S. I don’t think there is anything other than [cross talk] the pictures —
REPORTER: [cross talk] released by your department. I mean, they’ve have been aired all over national television throughout the day, the kids being held in the cages. We’ve only seen the boys.
NIELSEN: I will, I will look into that. I’m not aware that there’s another picture. Yes.

Lawyers and medical providers who have visited the Rio Grande Valley shelters described play rooms of crying pre-school aged children in emotional crisis. The Associated Press learned that the government also plans to open a fourth shelter to house hundreds of young migrant children in Houston, where city leaders denounced the move on Tuesday.
[….]
The three centers — in Combes, Raymondville and Brownsville — have been rapidly repurposed to serve needs of children including some under 5. A fourth, planned for Houston, would house up to 240 children in a warehouse previously used for people displaced by Hurricane Harvey, Mayor Sylvester Turner said.
Turner said he met with officials from Austin-based Southwest Key Programs, the contractor that operates some of the child shelters, to ask them to reconsider their plans. A spokeswoman for Southwest Key didn’t immediately reply to an email seeking comment.
“And so there comes a point in time we draw a line and for me, the line is with these children,” said Turner during a news conference on Tuesday.
Doctors and lawyers who have visited the shelters said the facilities were fine, clean and safe, but the kids — who have no idea where their parents are — were hysterical, crying and acting out.
“The shelters aren’t the problem, it’s taking kids from their parents that’s the problem,” said South Texas pediatrician Marsha Griffin who has visited many.
Alicia Lieberman, who runs the Early Trauma Treatment Network at University of California, San Francisco, said decades of study show early separations can cause permanent emotional damage.

Let’s just watch how this plays out. This will go on for another couple weeks, maybe even a month and then ICE and DHS will return to the same policy that existed two years ago and Trump will claim that the trump administration has corrected the terrible democratic policies and laws that led to the separation and warehousing of children. Get it-they’ll return to the Obama approach to border security and will claim credit for having corrected the Democratic border issues that the Trump administration created.
The local news was in Comes & had authorities called on them twice. They could not get in to see the girls & toddlers, but spoke with a deacon from the Catholic Church who said the kids for running & crying to them, but they are not allowed to hug them.

Kristen Nielsen is wondering which government office released the pictures that are everywhere, but that she claims to have never seen. Really, that’s her question? Well, she knows full-well that they (our government) is CONTROLLING the images of the children who were kidnapped from their parents, who are being held against their will.
It doesn’t GITMO sadder than that.

Trump child separation policy akin to kidnapping – senior Texas official
[….]
Maureen Franco, the head of the public defender’s office that covers much of the border between Texas and Mexico, said her team of lawyers were now dealing with so many cases hauled into criminal court after unlawful border crossings that it is like “a cattle call” of distraught parents.
Many clients are “inconsolable” after having their children taken away, she told the Guardian in an exclusive interview.
She considers the children “kidnapped” by the government, she said. “Without any authority to do that … the child is taken by force,” she added, in the weeks since the Trump administration declared “zero tolerance” of illegal border crossings from Mexico and began tearing families apart.
Franco’s office sits in a nondescript federal building in downtown El Paso, just a mile from the US border with Mexico, opposite the court building where the cases are piling up.
Dozens of distraught parents are being put before a judge on criminal charges every day, many fleeing violence and poverty in Central America and Mexico. Franco and her team of public defenders have suddenly found themselves on the front lines of the chaos, confusion and heartbreak caused by the way the laws are now being enforced.
She described the unlawful misdemeanor that the migrants are routinely charged with after a first unauthorized border crossing as “a petty offense”.
“They are taking children away from their parents for the equivalent of a traffic ticket,” she said.
[…]
She made the point that parents who are innocent until found guilty but are being separated from their children at the outset is the equivalent of punishment before due process.
“The parental-child relationship is a fundamental right protected by the US Constitution,” Franco said. “Anybody in our country has the protection of the constitution. The supreme court has been clear about that. The parent may have committed a crime but the child did not. Children have rights and these are being trampled on.”

Governors withdraw National Guard troops over family separation policy
The governors of multiple East Coast states have announced that they will not deploy National Guard resources near the U.S.-Mexico border, a largely symbolic but politically significant rejection of the Trump administration’s “zero-tolerance” immigration policy that has resulted in children being separated from their families.
Maryland Gov. Larry Hogan, a Republican, announced Tuesday morning on his Twitter account that he has ordered four crewmembers and a helicopter to immediately return from where they were stationed in New Mexico.
“Until this policy of separating children from their families has been rescinded, Maryland will not deploy any National Guard resources to the border,” Hogan tweeted.
Massachusetts Gov. Charlie Baker, who like Hogan is a Republican governor in a blue state, on Monday reversed a decision to send a National Guard helicopter to the border, citing the Trump administration’s “cruel and inhuman” policy.
[….]
The resources in question from each state are relatively small, so the governors’ actions aren’t likely to have a huge practical impact. But they are a strong symbolic political gesture, said Mileah Kromer, the director of the Sarah T. Hughes field Politics Center at Goucher College in Towson, Maryland.
“I think at a time when you have a large percentage of the country questioning the leadership of the Trump administration, it certainly is a moment for the governors across the country to show leadership, particularly at a time when this is so divisive,” Kromer said.
[….]
Governors are not the only ones taking action: Mayors from across the U.S. announced plans to travel to the Texas border on Thursday to protest the “zero tolerance” policy. The mayors will gather at a point of entry near where migrant minors began arriving at a tent-like shelter last week.
The U.S. Conference of Mayors last week unanimously passed a resolution registering its opposition to separating children from their families at the border.

from huffpo: Some Prominent Conservatives Call On Trump To Stop Separating Migrant Parents & Children
Alan Dershowitz, a Harvard Law professor emeritus and staunch supporter of President Donald Trump, on Monday spoke out against the administration’s policy that separates migrant children from their parents at the U.S.-Mexico border.
During an appearance on “Fox & Friends” ― a show Trump is known to follow closely ― Dershowitz appealed to the president directly. “You have to end this policy of separating parents from children,” he said. “Not because of the parents, but because of the children.”
“It imposes a trauma on the children. It’s just unacceptable. It’s just not proper,” he went on. “There are other ways of doing this. You can send the parents and the children back together. You can do other things, but separating parents and children ― no matter where you put them, no matter how the facilities may look… It’s not the facilities. It’s the act of separating the parents from the children.”

House Speaker Paul Ryan addressed the ongoing immigration debate at GOP leadership’s weekly press conference on Wednesday.
Ryan said that the caucus aims to pass legislation that will “take action to keep families together” while also enforcing existing immigration laws. Under this bill, “families will remain together under DHS custody throughout the length of their legal proceedings.”
“We do not want children taken away from their parents. We can enforce our immigration laws without breaking families apart. The administration says it wants Congress to act and we are. Tomorrow, the House will vote on legislation to keep families together,” he told reporters.
courier-journal:
Opposition to President Trump’s controversial policy of separating migrant children from their parents at the border crossed partisan lines Tuesday as Sen. Mitch McConnell and U.S. Rep. John Yarmuth said they would support plans to fix the problem.
At his weekly news conference Tuesday, McConnell, the Senate majority leader, said “we hope to reach out to the Democrats and see if we can get a result.”
McConnell, a Republican, said Tuesday, however, that he supports efforts that he said would keep families crossing the border together while their immigration status is determined. He mentioned a plan by fellow Republicans Texas Sens. Ted Cruz and John Cornyn, who have introduced a separate proposal.
Under that measure immigrant families would be kept together unless there is aggravated criminal conduct or threat of harm to children
Cruz and Cornyn also want to expedite asylum cases by having a 14-day review process for those who meet the legal standards; double the number of federal immigration judges to roughly 750; and authorize new temporary shelters that can accommodate migrant families.
“I understand the president just called on us to fix the problem, and obviously for that to occur in the Senate would require bipartisan discussions,” McConnell said.
Sen. Rand Paul, R-Ky., also broke his silence on Trump’s policy after dodging reporters on Monday.
“I strongly support enforcing our immigration laws, securing our border, and protecting our country,” Paul said in a statement to the Courier Journal. “At the same time, I oppose the government separating families.”
Yarmuth, a Democrat, told the Courier Journal the policy is a “humanitarian crisis” and said he would back the Keep Families Together Act spearheaded by New York Congressman Jerrold Nadler, the ranking Democrat on the House Judiciary Committee.
Nadler’s proposal mirrors a Senate bill proposed by Democrat Diane Feinstein of California that prohibits the Department of Homeland Security from taking children from immigrants at the border unless there is evidence that the children are being abused or trafficked by their parents.
Besides blocking Homeland Security from taking an immigrant’s child, it also requires Border Patrol agents to undergo child welfare training and to establish rules for reuniting parents with their children.
Unlike the Senate version, the bill Yarmuth signed limits prosecuting immigrants coming to the U.S. seeking asylum. It also codifies a refugee protocol that prohibits the criminal punishment of those seeking protection from persecution, according to the congressman’s office.
Yarmuth said this is a solid proposal that Republican leaders should seriously consider. He said this past week has shown the need for Congress to intervene.
“The Trump administration’s policy has created a humanitarian crisis along our own border, with children being kept in cages and crying for their parents,” he said. “If the president is not going to reverse his action then we need to come up with a legislative fix.”

Trump signs family separation executive order
Donald Trump has signed the executive order ending family separation at the White House.
Did Michael Cohen just drop a hint about flipping on Trump?
President Trump’s embattled longtime personal lawyer Michael Cohen just distanced himself from Trump in an unprecedented way. And it’s difficult not to read it as a sign that he might flip on Trump.
Cohen just withdrew as a deputy finance chair of the Republican National Committee. And according to ABC News, his reason includes not just the major federal criminal investigation he faces, but also a policy difference with Trump.
“As the son of a Polish holocaust survivor, the images and sounds of this family separation policy is heart wrenching,” Cohen wrote in his letter to the RNC. “While I strongly support measures that will secure our porous borders, children should never be used as bargaining chips.”
Elsewhere in his letter, Cohen offered the more obvious reason for his resignation: The investigation. “This important role requires the full time attention and dedication of each member,” he said. “Given the ongoing Mueller and [Southern District of New York] investigations, that simply is impossible for me to do.”
[…repeats here past quotes of loyalty….]
But nobody says they are going to flip before they flip. At the least, Cohen may be sending up a trial balloon — a signal that his loyalty to Trump isn’t as absolute as it once was, and that perhaps Trump should do something to regain that loyalty (a pardon?). Cohen had to know that registering this policy difference would lead to this kind of speculation, even if he’s not necessarily committed to flipping.
The plot thickens.
hey pogo,
Democratic Sen. Joe Manchin leads his Republican challenger Patrick Morrisey in the West Virginia Senate race, according to a Monmouth University poll released Wednesday.
Manchin represents a top GOP target this cycle, with West Virginia being one of five contests where Democratic senators are seeking re-election in a state President Donald Trump carried by double-digits in 2016.
The survey shows Manchin with a 48% to 39% advantage over Morrisey, the state’s attorney general. Another 4% back ex-con coal baron Don Blankenship, who lost the GOP primary in May and is now trying to run as the Constitution Party candidate. His bid is in question, however, because of West Virginia’s “sore loser” law.
Manchin holds a 49% to 42% lead over Morrisey without Blankenship in the race.
The incumbent Democrat maintains a similar lead over Morrisey when Monmouth uses different models to reflect historical midterm turnout and one with a Democratic surge.
Manchin’s lead comes even as the President remains widely popular in West Virginia, with 67% of voters in the state approving of his job performance compared with 29% who disapprove.
The Monmouth poll also finds a close race for an open seat in the state’s 3rd Congressional District between Democratic state Sen. Richard Ojeda and GOP state Del. Carol Miller.
Ojeda receives 43% support compared with 41% for Miller, although the Democrat’s lead expands when looking at the historical midterm turnout and Democratic surge models.

Should they get it it together and actually church Jeffy, it would be quite a treat for me, a Methodist at heart who attends a Baptist church because the Methodist church I was attending has dropped to six or eight members, most over the age of seventy. Jeffy deserves it, having allied himself with this criminal administration.
Did I hear nixon’s name invoked by the congressional repug brown noser meeting? How desperate are these guys? nixon and china. Just like reagan, the gop lies about everything and promotes corruption. It was GWH Bush that brought down the Berlin wall…not ronnie. ronnie was probably as corrupt as nixon and as fiscally irresponsible like trump.
BTW, it is now 101 degrees here.
Craig… IMO, it’s important for the press to do it’s job of reporting what is happening at our borders. Just because trump signed an executive order does not mean what is still happening is ok. Thank you… you’ve done a good job of that here.
trumpty dumpty threw around the term “compassion”…. there is absolutely nothing compassionate about this man… or for that matter many republicans.
Craig, what I read about the first Disney offer for fox claimed the more liberal james murdoch was going to get the entertainment (including sports) portion. rupert and lachlan would keep the news division under their control. james murdoch criticized trump after Charleston and has no interest in the propaganda networks.
fox and disney ink deal.
From the comcast offer — Murdoch would be deeply enriched either way — while still retaining Fox News, the Fox television network and other non-scripted assets he is believed to prefer. The Murdoch family owns about 17 percent of Fox shares.
Schmidt had more to say…
103 degrees now.
patd, Morrisey is slime. And I’m surprised SFB only has a 66% job approval rating here in West Bumfuck.
OK, on with the lawyer hat for a minute. Both SFB and Ernie, his Atty.Gen. who he hates, said that existing law required the separation of children from their parents who are arrested under Ernie’s zero tolerance policy, which policy is still in place unless the SFB Exec. Order changed that. If it was the case that the law requires that separation of families (it is not) the Exec. Order is an illegal order that violates the duly enacted laws of the US. Sooooo, either (a) SFB’s executive Order is illegal or (b) (horrors) SFB and Ernie (and SHS and Kirstjen Neilsen, etc. etc. ) have been lying to us about what the law is to justify their horrifically cruel separation policy.
That, considered in the context of Poobah’s 3:51 “loophole” comment means to me that wholly aside from the “where appropriate” squib, the language of the clause quoted by Poobah suggests that we will likely never see families kept together. There are 3 qualifiers in that clause alone – “where appropriate”, “and consistent with law”, and “and available resources”, any one of which could be cited at any time to justify separating kids from their parents.
That is what we in the legal world refer to as meaningless bullshit. (That’s a technical term – look it up. 🙂 )
Dems up by 8% in new cnn poll regarding house midterms.
The results of the “generic ballot” question had moved in the GOP’s favor since early this year — a 16-point lead for the Democrats in February dropped to a six-point edge a month later and dropped again in May to just three points. It has grown to an eight point lead for Democrats in the June poll, suggesting a slight rebound, with 50% of registered voters picking the Democrat and 42% going for the Republican.
BW, yikes … but is it a dry heat? (I’ve always kinda laughed about that – my experience is that anything over about 90 is a hot heat rather wet or dry, although I must admit I prefer less rather than more humidity when it’s hot out there).
….i would chance doing some jail time if i could get my hands on anyone of them fkrs…… – Mr Solar
Mr Solar, I would send you a cake with a diamond hack saw in it. However, I don’t think beating up puguglicns while they are committing political suicide is the best plan.
We should never forget, or shut up about, trump’s & ripofflicans’ illegal and unconstitutional kidnappings, systematic child abuse, and 6th Amendment violations, nor of the defense of those violations by rightwing, russia-linked fake news sources.

Wow! A busy day on the Trail.
So SFB made another theatrical “Executive Order” to undo something that was a whim by him and his freaky little elf that a real EO is not needed. I understand the TV version of the EO has a lot of misspellings in it – as usual.
Several hours are now spent pondering why he changed his mind. He did not. If he changed his mind he could have made a phone call, but that would leave him as the one villain, something he could not take. By creating a made for tv EO he sends the blame to the Congress. Slick move, shows he still has some brain cells working a little bit.
This exercise in being a Nazi (remember Godwin said Godwin’s Law does not apply to this situation) has given SFB and the greedy old perverts the boundaries they have. Right now they have pulled back, but expect other attempts to herd brown, black and LGBTQ people into concentration camps.
I concur Justice Pogo. Enough wiggle room in Trump’s order they don’t really have to change anything, more aspirational than mandatory.
PatD, when I saw Cohen’s statement the reference to the holocaust stood out. Did he call Trump a Nazi?
Excerpts from the EO:
Yeah, this is a serious EO, alright.
From the Wagner Miroff and Debonis WaPo article about the EO:
Somehow I am not comforted by the EO.
Thank you, Mr Pogo, Esq., J.D.
I love this.
You’d think at some point they’d realize that the stuff they say is recorded.
Ending the policy? I doubt it – see discussions of mine & Poobah’s above.
LULAC Dallas is organizing a trip to the border to protest separation & keep focus on this to ensure it stops & families are reunited. I hope the media will not let this go after today’s Trump show. I hope Dems & Republicans will stand strong against Trump going forward.
Seeing ~good Christian~ Mike Pence stand there with that smug look tells me that he has no more understanding of the New Testament than Jeff Sessions.
C’mon, Mikey. Be brave & lead the way for everyone to flip.
RR: “Just because trump signed an executive order does not mean what is still happening is ok.”
Amen, and for starters nothing in the order guarantees reuniting families already separated. My hunch is nothing changes for them.
Based on reporting nothing has changed except now they are stopping people from applying for asylum
“…nothing in the order guarantees reuniting families already separated. My hunch is nothing changes for them.”
craig, just heard that very thing. nothing in plans at present to reunite.
more than likely they didn’t keep track of matching records or put on the kids id wrist bands or tattoos a la Auschwitz … wonder if they have a sign over the door that says “arbeit macht frei”
from time:
President Donald Trump’s executive order ending his administration’s policy of separating migrant families is far from a solution to the border crisis, immigration advocates are warning – and could lead to immigrant children being locked up in detention centers with their parents for “months or years.”
“The President doesn’t get any brownie points for moving from a policy of locking up kids and families separately to locking them up together. Let’s be clear that Trump is making a crisis of his own creation worse,” said Karen Tumlin, director of legal strategy at the National Immigration Law Center, in a press call on Wednesday. “Children, especially those fleeing persecution, need safety and environments where they can thrive and play and be safe. They don’t need jail.”
[…]
Trump’s order also seeks to modify the terms of the latest settlement on the 1997 Flores case, which prohibits the government from keeping migrant children in detention for more than 20 days. Immigrant rights’ advocates on Wednesday said they worried about what that could mean for the due process rights of migrants and for their ability to make asylum claims from detention centers.
“Today’s order is likely to just have the effect of jailing families who are seeking safety for months or years,” Tumlin said.
Katharina Obser, a senior policy adviser at the Women’s Refugee Commission, said the order could result in expanded detention for immigrant families. She also worries that it’s even more difficult for families to pursue asylum claims while they are in federal detention.
Tumlin and other advocates are also concerned for the fate of the children who have already been separated from their families.
“We have no reassurance that the families that have been ripped apart — that those kids are going to be reunited and that this Administration is taking responsibility for its actions,” she said.
excerpt from business insider:
Yegani noted that the order doesn’t cover what will happen to the children and families who’ve already been detained. ”
There’s been no talk about how these kids will be reunited” with their families, she said. “There’s some parents who’ve already been deported.”
