The Financial Times might be stating the obvious, or the “bleeding” obvious, as the Brits say, but it will always be worth repeating.

In an editorial endorsing Hillary Clinton, the writers partly blamed “a media which have become more polarised than ever” for the rise of Trump:

In the search for higher ratings, too many have been happy to strike a Faustian bargain with Mr Trump.

It’s happened before, and will happen again, so long as access to voters is controlled by the ratings machine. In 2008 the pop star mentality boosted Barack Obama to stardom.

The big difference here is that Faust traded his soul to the devil in exchange for unlimited knowledge, not for Nielsen numbers.

Big night in CLE.  Cavs-Rockets at 6, Indians-Cubs at 8.

For those unfamiliar with the layout of downtown Cleveland, the Q where the Cavs are playing is separated from Jacobs Field by the parking deck for the Q. Absolutely can’t imagine how the Cleveland police will be able to handle them traffic in that area.

The worst thing that has happened is having paid flacks for the campaigns being paid by cable news to comment on the campaign.  CNN is the worst…MSNBC is not far behind.  I rarely watch Fox because they have had little credibility for years…

OD, I absolutely agree. Other than a quick  check in to see election projections on voting days,  I literally never watch Fox and almost never watch CNN (except maybe the occasional Anderson Cooper if he’s got an interesting guest – you know, like not Kelly-Ann Conway)

FBI Director James Comey argued privately that it was too close to Election Day for the United States government to name Russia as meddling in the U.S. election and ultimately ensured that the FBI’s name was not on the document that the U.S. government put out, a former bureau official tells CNBC.
The official said some government insiders are perplexed as to why Comey would have election timing concerns with the Russian disclosure but not with the Huma Abedin email discovery disclosure he made Friday.

tony, this may be why comey didn’t want to say anything… he would have been accused of clearing the drumpf and imo wanted to pass that responsibility off to dept of homeland security.  for the white wash to come out now tho’ from the fbi looks even worse.  me thinks there are some rogue agents at work in all this and perhaps comey is being cruelly  played by them.

ny times: Investigating Donald Trump, F.B.I. Sees No Clear Link to Russia

Law enforcement officials say that none of the investigations so far have found any conclusive or direct link between Mr. Trump and the Russian government. And even the hacking into Democratic emails, F.B.I. and intelligence officials now believe, was aimed at disrupting the presidential election rather than electing Mr. Trump.

In classified sessions in August and September, intelligence officials also briefed congressional leaders on the possibility of financial ties between Russians and people connected to Mr. Trump. They focused particular attention on what cyberexperts said appeared to be a mysterious computer back channel between the Trump Organization and the Alfa Bank, which is one of Russia’s biggest banks and whose owners have longstanding ties to Mr. Putin.

F.B.I. officials spent weeks examining computer data showing an odd stream of activity to a Trump Organization server and Alfa Bank. Computer logs obtained by The New York Times show that two servers at Alfa Bank sent more than 2,700 “look-up” messages — a first step for one system’s computers to talk to another — to a Trump-connected server beginning in the spring. But the F.B.I. ultimately concluded that there could be an innocuous explanation, like a marketing email or spam, for the computer contacts.

The most serious part of the F.B.I.’s investigation has focused on the computer hacks that the Obama administration now formally blames on Russia. That investigation also involves numerous officials from the intelligence agencies. Investigators, the officials said, have become increasingly confident, based on the evidence they have uncovered, that Russia’s direct goal is not to support the election of Mr. Trump, as many Democrats have asserted, but rather to disrupt the integrity of the political system and undermine America’s standing in the world more broadly.

This week is the busiest of my year…  as I need to get scarves shipped or delivered to all of my galleries by the end of next week.  Thank god I have an excuse to not pay much attention to all the negativity surrounding this election.  I have had enough and am ready to move on.

I will be rooting for the Indians tonight…  I love to see the hometown team win.

Will it mean anything to the media sell-outs if after November 8th people still tune in to watch them? Talk about them? Even a complaint is free publicity. I read the comments here, there, everywhere about Cable News X, Network Z. Yet the same complainers still watch …. Switch the channel, turn the TV off.

I stopped watching msnbc the minute (literally) Mr Olbermann signed off. Haven’t missed it a bit because I knew there was nothing/no one left there worthy of my time or attention. Plenty of options online for news. Ditch the cable, respect yourself. It’s a big world out here.

A September leak that spilled 252,000 to 336,000 gallons of gasoline occurred not far from the location of Monday’s explosion. That leak led to days of dry pumps and higher gas prices in Alabama, Georgia, Tennessee and the Carolinas while repairs were made.

When I was an active Clevelander, we would always take the Rapid to downtown happenings. We would drive to a parking spot not far from our house, get on the Rapid Transit (a light urban rail system that effectively links much of the metro area) and be where the action is within 15-minutes. Much better than driving and parking downtown.

Let there be no doubt, I am rooting for the Tribe with all the fervor that Moses Cleaveland envisioned when he caused this great City to be erected in Connecticut’s Western Reserve.

The case is a civil, not criminal action pending in the Federal District Court for the Southern District of New York, Case 1:16-cv-07673-RA. If you have access to the “PACER” document system, you can find the case docket (list of filings) and retrieve and download any filed document. The link is here. Below are facts I learned from the docket and filings.

1. The case was filed on September 30, 2016. The Complaint is supported by three sworn Declarations — from “Jane Doe,” “Tiffany Doe” and “Joan Doe.”

2. Jane Doe alleges at paragraph 2, “I was subject to extreme sexual and physical abuse by the Defendants, including forcible rape, that took place at several parties of Defendant Epstein during the summer of 1994 in New York City at a residence used by Defendant Epstein. During this period, I was 13 years old.” She further alleges she received death threats from Trump.

3. Tiffany Doe alleges she arranged for Jane Doe to be at Epstein’s parties and witnessed the alleged abuse and death threat.

4. Joan Doe alleges Jane Doe contemporaneously told her about the incident.

5. The Complaint in the action seeks damages and a protective order against the defendants.

6. Electronic summons were served on the defendants on October 12, 2016, requiring a response to the Complaint  within 21 days after service. (i.e., November 2, 2016) (i.e., This Tuesday!) (note — this period is often extended by agreement or by the Court)

7. Defendants have not yet responded to the Complaint.

8. A case conference with Judge Ronnie Abrams is scheduled for December 16, 2016.

Under Rule 11 of the Federal Rules of Civil Procedure, an attorney filing any paper certifies that:

(1) it is not being presented for any improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation;

(2) the claims, defenses, and other legal contentions are warranted by existing law or by a non-frivolous argument for extending, modifying, or reversing existing law or for establishing new law;

(3) the factual contentions have evidentiary support or, if specifically so identified, will likely have evidentiary support after a reasonable opportunity for further investigation or discovery.

If any of these are not true, the other side can move for sanctions, including their attorneys fees.

No pleading or motion under Rule 11 has been filed.

What is the Western Reserve?

 

Northeastern Ohio’s cultural roots begin with the native American populations who first inhabited the area some 10,000 years ago. In 1662 the area became part of the colony of Connecticut whose royal charter granted it a swath of land extending across the continent to the Pacific Ocean. After the formation of the United States, Connecticut ceded most of its western lands to the national government but exempted approximately 3,400,000 acres lying north of latitude 41 degrees and extending 120 miles westward from the Pennsylvania border. This became its Western Reserve. In 1795 it sold most of this land to a group of investors who had formed the Connecticut Land Company and in the following year the company began the survey of the land to prepare it for sale. The survey party was led by Moses Cleaveland, the namesake of Cleveland, Ohio.

 

Initial settlement of the area was sporadic and slow, however by the 1820s, the region began to prosper. The first settlers and the towns they established reflected the culture of Connecticut and New England. However, as the region prospered it became a destination for migrants of all backgrounds and the region became increasingly diverse in terms of race, ethnicity and religion. With the growth of industry in cities such as Cleveland, Lorain, and Akron during the late nineteenth century demographic diversity increased markedly – so much so that by 1920 two-thirds of the population of Cleveland was of foreign birth or parentage. In the years since 1965 new immigration streams have added markedly to the cultures and communities within the region.

 

Today, economists and planners see northeastern Ohio as a contiguous region, one which almost matches the borders of the Connecticut Western Reserve. The region continues to grow, garnishing recognition from national media as an “emerging destination” with one of the “10 best City Arts Districts in the USA” in University Circle, the neighborhood the Western Reserve Historical Society calls home.

Cleveland’s extraordinary mixture of cultures and histories, dating from native American to contemporary immigrants continues to be reflected in its landscape and cities, and most importantly in the collections preserved in the Western Reserve Historical Society’s collections and properties

If Huma Abedin is correct in stating that she does not recall ever accessing emails on that computer, does it not follow that the emails were planted there?  As long as Abedin is telling the truth, it seems more likely than not to me that the emails are old ones that were planted.   FBI agents in NY have had sole custody of that computer for a while.  That the overwhelming majority of FBI agents are honest and competent I am certain.  But I am equally certain that not all of them are, that is just how it is.  I worked for the IRS for 24 years, believe me I know. …..

Thus, unless the FBI has already verified by technological means that the emails were accessed on that computer during the time HRC was actually Secretary of State, I think the chances are greater than 50% that the emails were planted by “deplorables.”  Comey has been grossly negligent in giving the situation legitimacy and publicity if this very likely scenario has not been ruled out.

pogo and other abogados out there, what do you make of this interesting advice to abedin’s lawyers from angrybear with regard to possible plant?

So there are three steps that Huma Abedin should take, immediately. First, she should have her lawyers file an emergency court petition tomorrow requesting the immediate sealing and impoundment of Weiner’s laptop and of all other electronic devices taken through the search warrant concerning Weiner’s online sexual activities.

The petition also should request that she be allowed to have Weiner’s computer examined by an independent, non-government computer forensics experts, in the company of FBI computer forensics experts who are from an office far, far away from NYC and Washington, DC, and who have never worked at either of those offices.

And the petition should request disclosure to her of the identities of the FBI agents who, by Comey’s apparent acknowledgement, threatened him with leaks of what they claim are on Weiner’s computer.

Second, she or her lawyers should file a formal complaint with the Justice Department’s Office of Inspector General, requesting investigation into who was threatening Comey with leaks and damage to Comey’s reputation if Comey himself did not make public the existence of State Department-related emails on Weiner’s computer.

The complaint also should request inquiry into Comey’s decision to make public raw information gained by dint of the FBI’s police powers and the Justice Department’s prosecutorial powers, for what he himself has stated was for the purpose of affecting votes for national elective office.

Third, she should ask that her lawyers, immediately after those are filed, hold a press conference detailing what is in the emergency petition and the complaint to the Inspector General’s Office.

Also immensely important: that the fact that that information did end up on Weiner’s personal computer—one that given what he did use it for, was not one that he likely would have invited Abedin to use—has not an iota to do with the facts that Clinton used a private email account and a private server.  Presumably, all sorts of other high-level government employees, some in sensitive positions, probably access their government email accounts from home and also probably do work from home.

And then, of course, there is this: the fact that the FBI has, since late Friday or early yesterday, pushed the claim that Abedin herself had provided that computer to the FBI last spring—after Comey said that Abedin had NOT produced it during the investigation of the email matter, and that that is why he felt compelled to “update” the public–er, the Congress–does speak quite loudly, doesn’t it?

Patd, I’m definitely good on #1 & 3.    #2 sounds like a good idea as well.  If that follow on musing is correct, Comey has things to answer for beyond the letter to Congress since if angrybear is right and the computer was turned over to the FBI by Abedin last spring, he is misleading the public about the chief aide to HRC in the runup to the election.  That is a clear attempt to move votes away from Clinton IMHO. It is fairly clear that the FBI had that computer in the Weiner investigation, and there ain’t a straight faced argument that the agents investigating Weiner weren’t aware of the Clinton-Abedin emails on it and the HRC email investigation.

Kerr says he assumes the FBI obtained a warrant to search Weiner’s computer, as is required absent special circumstances. The search warrant presumably authorized a search relating relating only to Weiner’s communications with underage girls, Kerr says.

The first issue, he says, is whether the FBI was permitted to search through Abedin’s email account for records of Weiner’s improper messages to underage girls. He notes a Colorado Supreme Court case—which he has criticized—that dealt with officers who had a warrant to search for texts between a suspect and an undercover officer posing as an underage girl. The court found a search of a different folder that contained texts to a real underage girl violated the Fourth Amendment.

There might be similar problems in Clinton’s case because Weiner’s alleged texting crimes occurred in 2016. Hillary Clinton was secretary of state from 2009 to 2013. “If I’m right that there was a several-year gap between the warrant crime and the second investigation, it’s not clear the government could search through older emails for evidence of such a recent crime,” Kerr writes.

A second issue is whether the FBI could seize the Abedin emails because they were outside the scope of the warrant, Kerr says. The “plain view” exception allows a law enforcement official who is searching a computer to obtain a second warrant to search for items in plain view that are evidence of a second crime. That standard may not be satisfied in the Clinton case, Kerr says.

“The plain view exception does not allow evidence to be seized outside a warrant unless it is ‘immediately apparent’ upon viewing it that it is evidence of another crime. Just looking quickly at the new evidence, there needs to be probable cause that it is evidence of a second crime to justify its seizure, which would presumably be necessary to apply for the second warrant,” Kerr writes.

“The Fourth Amendment plain view standard doesn’t allow a seizure of emails based on a mere we-hope-to-later-determine standard. The government can’t seize the emails just because the Clinton investigation is extra important and any possible evidence is worth considering.”

Emerson-Lake-Palmer were so far ahead of their time it is hard to even nail down where they would have fit.  The electronics were still primitive compared to today. Even for ten years later, in the 1980’s.  GaryNuman and they would have been a wild album.

Watching the evening D.C. news, Todd whatshisfacewiththeweirdstuffonit, stopped by to let us know that HRC is doomed and the bloater has a way to win the White House with a path that is scary.  It includes solid Dem states to flip to sexual predator states.

Tried to vote today.  The lines were still as long as last week.  Crazy  voting.

Is the FBI trying to swing the election?

Here is a strange thing that happened: An FBI-affiliated Twitter account, which had been dormant for a year, sent out a boatload of tweets on Sunday, then released 129 pages of documents on Tuesday related to the FBI’s investigation into Bill Clinton’s controversial 2000 pardon of donor Marc Rich.

The documents were apparently put online on Monday, but weren’t tweeted until Tuesday and appear to have resulted from an FOIA request. According to Bloomberg, it’s “standard FBI practice” to post those documents online. What isn’t standard—given that the FBI Vaults account was dormant for so long—is to tweet those documents out. (One of the items tweeted on October 30 related to Fred Trump, Donald Trump’s father, but did not contain any damning information.)

Chicago has very restrictive gun laws.  In areas with less restrictive laws the rates are not an issue.  It is the behavior of the depressed and lawless communities under the control of the democratic policy.  this is more dangerous then the disaster that Hillary helped to create in the middle east.

To all those that read these posts stop and think – We need real change and Trump – Yes crass but not corrupt will bring common sense.

It forever exposes the hypocrisy of the Evangelical Right’s “Family Values” platform, as they put their support behind an almost literal Golden Calf and idolizer of his own name.  Just about everything Trump stands for (especially in his personal life) runs contradictory to the teachings of Jesus.  Trump brags about his wealth, and he only defines how “good” people are in terms of how it benefits HIM.  Trump has said that he doesn’t really see the need for repentance.  And don’t get me started on the “Two Corinthians” thing.
2)  Now that I have the answer to this question, it doesn’t matter how conservatives convince themselves that Trump is “a newborn Christian”, or claim that he can be baptized on national TV to convince people of his faith.

It is up to each of us to treat each other with respect and truth.  If you look at the micro elements of the campaigns in recent days Hillary is all hate, negative and attack attack.  Trump is Policy addressing the Failed ACA AKA Obama Care,  Addressing Jobs and national defense to repair the damage from Hillary.

Regarding your post the conservative evangelical  are stuck with Trump and they will see both as very flawed.  They will vote for him vs Hillary for many reasons.

Why would anyone support abortion after 20 weeks with only medical exception for the mother (or like extreme issue)  How can we charge a person with double murder when they kill the mother of the unborn child but an abortion after 20 weeks is allowed without any consequence? How can the life count in one case but not the other?

within 20 weeks is more then adequate time to make a choice.  I agree with Choice.  But beyond 20 weeks?

Hillary supports beyond 20 weeks.  This is reason enough for evangelical to not vote for Hillary.
