NPR story this morning on it:
President Trump’s longtime attorney, Michael Cohen, will invoke his Fifth Amendment right against self-incrimination in a civil lawsuit brought by adult entertainer Stormy Daniels â a move that would prevent him revealing anything that could be used later by federal prosecutors.
“Based on the advice of counsel, I will assert my 5th Amendment rights in connection with all proceedings in this case due to the ongoing criminal investigation by the FBI and U.S. Attorney for the Southern District of New York,” Cohen wrote in the filing in Los Angeles federal court.
[….]
“Talking, when you’re the subject of an investigation, when they are thinking that this contract was a federal crime … is incredibly reckless,” Ken White, a former assistant U.S. attorney in Los Angeles, tells NPR.
“The only sensible thing to do is shut up and not make it worse,” he says.
Cohen’s lawyers have asked for the case to be put on hold for 90 days, which could give Cohen and his legal team an opportunity to see the direction the FBI is moving.
Ultimately, however, the move could help Stormy Daniels in her suit, according to Renaldo Mariotti, a Chicago-based attorney and former federal prosecutor.
“[The] judge or jury could draw what is called and ‘adverse inference.’ In other words, they could conclude that the answers to the questions that he’s taking the Fifth on would have hurt him,” Mariotti tells NPR.

Citing the Fifth Amendment in the Clifford case allows Mr. Cohen to avoid being deposed and revealing sensitive information in the more important criminal investigation. That investigation â which prosecutors say has been going on for months â became public in dramatic fashion on April 9, when agents from the New York office of the Federal Bureau of Investigation raided Mr. Cohenâs office, apartment and a room at the Loews Regency Hotel he had been using. The inquiry is said to be focusing on hush-money payments that Mr. Cohen made to â or helped arrange for â Ms. Clifford and Karen McDougal, a former Playboy model who has also said she had an affair with Mr. Trump.
For days now, prosecutors from the United States attorneyâs office in Manhattan have been sparring with Mr. Cohenâs lawyers â and with lawyers for Mr. Trump â for the right to review the records first, a step that will shape the contours of how the government presses its investigation into whether Mr. Cohen tried to suppress negative news coverage of the president in the run-up to the 2016 election.
Lawyers for Mr. Cohen suggested on Wednesday that they were already taking steps to gird themselves for battle. In new court papers, they said that they were setting up âwar roomsâ to review the seized materials, testing and vetting âsystemsâ to process them, and marshaling what seems to be a small legal army of âoperations and technology personnel, paralegals, discovery experts, associates and senior reviewing partners.â
The martial tone of Mr. Cohenâs filing was in contrast to a similar letter submitted to the court by lawyers for the Trump Organization, who merely noted that they were âfully capable of processing and reviewing the materials.â In a third submission, Mr. Trumpâs lawyers said that they would âconsult closely with Mr. Cohenâs counsel to assist in identifying the seized materials that relate to the president.â
All of the papers were requested in advance by Judge Wood, who, in a hearing on April 16, put off a decision on how to resolve the conflict over the attorney-client privilege review, saying that she might appoint a special master to oversee the process. Two days later, the prosecutors and Mr. Cohenâs lawyers submitted to Judge Wood lists of potential candidates.
A beautiful morning glory to the trail. Attempting to catch-up on the posts. The mocking birds have been singing all night long for weeks.
Keith Davidson, the lawyer who represented Daniels at the time, also represented the Playboy model with whom Broidy had an affair.  Davidson declined to comment on the settlement. âI canât confirm or deny the existence of such matters,â he said. âBut Iâve always acted in my clientsâ best interests and appropriately in all situations.â
âMr. Cohen reached out to me after being contacted by this womanâs attorney, Keith Davidson,â Broidy said in his statement. âAlthough I had not previously hired Mr. Cohen, I retained Mr. Cohen after he informed me about his prior relationship with Mr. Davidson.â
