    NYPost quotes her trainer Wayne Lucas:

    Lukas believes she could be one of the best fillies he has ever had. That belief and her winning the Kentucky Oaks in impressive fashion the day before the Derby inspired him to enter Secret Oath in the Preakness Stakes, where she could give the 86-year-old Hall of Fame trainer a record-tying seventh victory in the second jewel of the Triple Crown.
    “She gives you reason every day to feel good,” Lukas said from his usual spot in the corner of the stakes barn at Pimlico, where he holds court every morning as horse racing’s elder statesman. “The best is still in front of her.”

    Secret Oath seemed to take to Pimlico as well as her trainer, who considers himself fortunate to have had so much success at the track beyond the Preakness. Natural talent could help her add to Lukas’ list of accolades, but his training has a lot to do with her evolution.
    “He’s a magician,” said retired jockey Donna Brothers, now an NBC Sports analyst. “He’s been doing it for a number of years, and he can continue to produce those sorts of results.”
    He has gotten those results since 1980 when he won his first Preakness with Codex. After Codex beat Kentucky Derby-winning filly Genuine Risk in that race, Lukas doesn’t see much poetic value in having a filly in Secret Oath who could get the job done 42 years later.
    “Filly, colt, government mule — I don’t care,” he said. “I’m here to win the thing.”

Poobah,  I scanned the case you provided a link to regarding Eastman and his attempts to shield documents from the 1/6 committee.  The brief and argument strike me as pretty weak tea.  For instance, the Eastman team relies on a case – Admiral Ins. v. U.S. District Court (AZ) – for the proposition that a number of documents sought by the Committee are protected by the work-product rule in Fed. Rule Civ. Proc. 26(b)(3) for documents that were developed for litigation for which Eastman and his NPO had not identified or been retained by a client. All well and good, except that Admiral dealt with a claim of Attorney-client privilege and only mentioned work product to distinguish the burden that must be met to overcome the Attorney-client privilege as opposed to the work-product rule in 26(b)(3). If I can see that distinction I can’t imagine that Judge Carter, Middle District of Cal. and his crack clerks will miss it.

    what you noted in the eastman case PLUS the little thing about no lawyer/client privilege when the client and lawyer are up to no good plotting a crime.  didn’t the good judge note that they possibly committed felonies trying to overthrow the gov’t?

    After a string of weeks here around 99F or 100F , it will be 70F here on Sunday.  And fall back to what was once called average  here next week.
    And Colorado is forecast to get 31 inches of snow.

    99 % of everything that ever lived on Earth is now extinct . 
     
    Here’s the  phrase to watch this fall –
    ” Indoctrinate our school children with their Radical ‘Woke Agenda’ ” 
     
    This is a fight about our history , and who writes those “books” , and like baby formula  it’s in the hands of a very small group of people trying to make money.
    It’s about whether we tell  our kids about Kit Carson’s  ride on the news of the  conquest of California to tell the East we won the Mexican War , or we also tell about his war on the Navajo . Where he drove them to Ft. Sumter , N.M., to live in holes in the ground for 5 years. 
    He killed all their livestock , burnt all their homes , and  destroyed  their peach trees.
    Then he marched them to the fucking Pecos river  where Billy the Kid was shot much later on.
    Yes that back drop of all those  John Ford movies,  in the 1850’s had peach trees growing in little side canyons where water was. 
    The Navajo  got the  seeds from missions. 
    Can you imagine  eating a peach i 1803 in Arizona ? 
    As an American rabbit hole , Kit Carson’s  life  is worth the time to read .
    He  was serving  as a 16 year old in a harness shop in St. Jo . Mo.
    Then the Bent Brothers came came to town up the Santa Fe Trail.
    He ran off with them . Back down the trail, and this was very early in that story.
    He broke his contract with the harness maker. The guy put an ad in the paper for him , the reward was 6 cents.
     

  30. patd, yes, the good judge did say that. Yes, the crime/fraud exception trumps (pun intended) attorney-client privilege. That said it’s seldom invoked. Concern is that it has a chilling effect on the atty-clt relationship.
