“He’s a magician,” said retired jockey Donna Brothers, now an NBC Sports analyst. “He’s been doing it for a number of years, and he can continue to produce those sorts of results.”
He has gotten those results since 1980 when he won his first Preakness with Codex. After Codex beat Kentucky Derby-winning filly Genuine Risk in that race, Lukas doesn’t see much poetic value in having a filly in Secret Oath who could get the job done 42 years later.

For instance, the Eastman team relies on a case – Admiral Ins. v. U.S. District Court (AZ) – for the proposition that a number of documents sought by the Committee are protected by the work-product rule in Fed. Rule Civ. Proc. 26(b)(3) for documents that were developed for litigation for which Eastman and his NPO had not identified or been retained by a client. All well and good, except that Admiral dealt with a claim of Attorney-client privilege and only mentioned work product to distinguish the burden that must be met to overcome the Attorney-client privilege as opposed to the work-product rule in 26(b)(3). If I can see that distinction I can’t imagine that Judge Carter, Middle District of Cal. and his crack clerks will miss it.
