“In the teleconference, Plaintiffs’ counsel made a meaningful attempt to resolve the underlying legal issues by agreement, including advising the Vice President’s counsel that Plaintiffs intended to seek immediate injunctive relief in the event the parties did not agree,” lawyers for Gohmert and the electors said in the filing. “Those discussions were not successful in reaching an agreement and this lawsuit was filed.”
The revelation was made in a filing in which Gohmert’s attorneys sought an expedited schedule for a ruling to try to press U.S. District Judge Jeremy Kernodle of the Eastern District of Texas, a Trump appointee, to decide the case by Jan. 4, two days before the certification.
The decision by Pence, one of President Trump’s most ardent loyalists, marks one of the most notable breaks with his boss, who has pushed lawmakers to challenge Congress’s certification of the Electoral College results. Pence will oversee the joint session on Jan. 6 during which Biden will be recognized by Congress as the victor in the White House election, though the role is largely ceremonial.
Pence has not made any public remarks indicating how he plans to handle the Jan. 6 joint session of Congress, nor has he commented on Trump’s unrelenting pressure campaign urging lawmakers to reverse the Electoral College results.

That is one reason they try to get a bill to the desk with enough time to prevent a pocket veto. Because stupid vetoed the DoD bill it went back to the Congress which could either forget about it or override the veto with a two thirds vote. The House has voted and it passed and is now in the Senate. Under Senate rules it can be voted on anytime the senmjldr puts it to the floor. Would senmjldr kill the DoD bill? He is that horrible, but I think he wants to get it passed. I will be interested in who does not vote or votes no.

As we approach January 20, 2021, I see some Dems wanting Biden to bring in their people. I see little shouting about centrist Dems. I see dislikes stated about how many Obama staff have been picked. From what we know that SFB has fired, removed and drove away from federal service, and what we can guess has not been made public, the need for people in place on day one who are experienced and know what is supposed to functioning becomes critical. Once the departments and agencies are stabilized, then we can talk about adding in our liberal people. Although my department has not been a focus for destruction, he has made some attacks though, we have serious issues to resolve. Other departments and agencies I work with have suffered horribly, but the worker bees have done their best to keep them functioning. Those will require solid leadership to refloat the agencies, there is no time to learn on the job for those. For my department Biden selected a previous secretary to return and do the job. It is very comforting to know we will have someone who knows the job, and also who should be there to remove the moles. For these last four years I have not removed his or Obama’s pictures from my cube wall.
patd, my understanding is that the basic funding for DOD is in the budget so the troops are paid, like the rest of the government workers, but that the DDAA sets funding priorities for the military (like the raise for the troops in the bill) so that essentially the status quo is maintained re: expenditures of funds. The procedural vote Wednesday on a motion to proceed to the veto override on the annual defense measure, H.R. 6395, was 80 to 12. Absent agreements being reached in the meantime, the next procedural move in the Senate may be a vote Friday to limit the hours of debate.
